The Screening of Third Country Transactions Act 2023 (the “Act”) was signed into law by the President of Ireland on 31 October 2023 and came into operation on 6 January 2025. The Act introduces a new regime for screening foreign investment into the Republic of Ireland and requires mandatory notification to the Minister for Enterprise, Tourism and Employment (the “Minister”) of certain foreign investments from outside of the EEA and Switzerland. Pursuant to the Act, the Minister reviews the investments based on a range of security and public order criteria, with a view to authorising, prohibiting or conditioning those investments as appropriate.
